The Government announced on 10th March that the current moratorium in place for both residential and commercial evictions was being extended.
The residential eviction ban now remains in place until at least 31st May 2021.
In England only, enforcement action can still be taken for cases of “substantial arrears”, which has been defined as six months’ rent arrears.
The commercial eviction ban has been extended to 30th June 2021.
The commercial moratorium covers CRAR (commercial rent arrears recovery), forfeiture of lease, statutory demands and winding-up petitions.
However, enforcement action under a writ of possession can still be taken against trespassers, including activists, squatters or travellers.
